Do I sue? Do I need a Lawyer?

by admin on March 1, 2011

My husband and I were sitting in our living room when a driver crashed into his parked car just inches away form our front door and where we were sitting. His car was flipped onto its roof. We live in Florida witch is a ‘no fault state’ so no matter what happens my husband will get reimbursed ( there is no repairing the car, its gone). But my husband is furious. He is a mechanic and put tons of time, work, and money into the car. Is it smart to sue (meaning would it be a waste of time) and should we get a lawyer (we win, but the lawyer fee are more than the settlement, then it would be a bad idea for a lawyer). What should we do. Should we sue, Should we get a lawyer?
1. My husband is only gonna get reimbursed for kelly blue book value of what it would sell for new today. Not what he paid for it, and not all the money in upgrades he put into it.
2. Also, my husband and I are prior military. For the few seconds we ran for cover, our home was no longer our home. We were back in Iraq. We don’t feel safe in our own house, and that’s pretty ****ed up! So aside from the car, if its not to much of a stretch, it would be nice to get some compensation for what we went through.

You said that your husband’s going to get reimbursed. So … what would you be suing for?

You can’t get more than the value of what you lost.

First off No Fault means your medical Bills will be reimbursed. You will have to sue for the car
Easiest way is to call your car insurance company and put in a claim on your collision. Your insurance company in turn will sue the other driver’s insurance Company No cost to you.

you don’t need a lawyer if no one was hurt your only going to get the book value for the car it wont do any good to fight this you can buy back your old car to part out but since no one was hurt all your going to get is book value
