If you used a denture cream containing zinc and developed a neurological disorder, a Poligrip or Fixodent lawsuit settlement can help you recover money to pay for your losses. As with every type of lawsuit, however, to stand a strong chance of succeeding in a denture cream lawsuit, certain criteria must be met. What follows is a discussion of what the grounds for a Fixodent lawsuit are, and how you can go about establishing them.

The Food and Drug Administration (FDA) recently issued a notice to denture adhesive manufacturers outlining its increasing concern over the link between denture cream zinc and health problems. Specifically, the FDA names myeloneuropathy of the extremities as a disorder commonly suffered by denture cream users and consistent with zinc toxicity.

Myeloneuropathy is a condition that occurs when the protective coating of the peripheral nerves is damaged. When this happens, a person may experience a number of symptoms, including:

Weakness

Pain and tingling in the arms and legs

Difficulty walking,

A sense of numbness in the hands and feet

A denture cream user could develop neuropathy because their adhesive product contains zinc, a mineral that can be toxic in large doses. Too much zinc can lead to a copper deficiency, and a lack of copper can cause damage to the nervous system.

While myeloneuropathy is associated with the overuse of denture cream containing zinc, the condition isn’t necessarily the result of zinc poisoning. To establish that your nerve damage was caused by a product such as Fixodent or Poligrip, which will be necessary for success in a lawsuit against the companies that manufacture them, you must confirm you have high zinc blood levels and/or low copper levels. To do this, visit your doctor for testing. Be sure to mention that you have been using a denture cream with zinc, so that the cause of your disorder is not misdiagnosed.

Finally, while it may seem obvious, you must be using, or previously have used, a denture adhesive formulated with zinc. All Fixodent products still contain zinc, but some types of Poligrip were reformulated last year to be zinc free. There are also numerous generic denture creams, some of which contain zinc. To find out the contents of your denture cream, check the label or visit the manufacturer’s website.

To summarize, in order to have a chance at recovering financial compensation from a denture cream manufacturer such as GlaxoSmithKline or Procter & Gamble, your case must meet specific parameters. First and foremost, you must have suffered neurologic injury. As a corollary, your neurologic impairment must be the result of zinc poisoning. Note that you may in fact be suffering from zinc poisoning, but it has not yet progressed to the point of damaging your nerves. Zinc poisoning, while characterized by some unpleasant side effects, will entitle you to little, if any, compensation. On the other hand, damage to your nerves can cause losses such as lifelong pain, suffering, and the inability to perform daily tasks, not to mention costly medical bills and time missed from work.

The Rottenstein Law Group wants to help those injured by denture cream. We understand that you used denture adhesive believing it to be safe. The fact that it wasn’t, and worse, that the manufacturers did not warn about its potential risks, is certainly not your fault. What you need and deserve now is legal representation that will help you recover the losses caused by a blameworthy corporation through a Poligrip or Fixodent lawsuit settlement. The lawyers of RLG have been helping innocent consumers obtain financial compensation for more than 25 years. If you believe you or a family member suffered neurological damage caused by Fixodent or Poligrip.
