Dealing with the effects of an accident in which injuries were sustained can be difficult enough, but the process of claiming compensation for your losses can be even harder.  Having filed your claim and submitted sufficient evidence to prove the accident was caused another party you will then be faced with the decision to settle once the insurance company makes an offer.

It goes without saying that you will want to ensure you receive adequte compensation to cover all your losses and perhaps to cover furture health costs arising from your injuries.  The decision on when to settle a claim and accept an offer of compensation is not one which should be rushed, particularly if you feel you should be offered more.  But even before you get this stage you should seek expert legal advice from a Maryland personal injury lawyer who will help you with the claims process and ensure your legal rights are protected throughout.

You are perfectly within your rights to decline any offer made by the insurance company.  In most cases a claim is settled before it goes to court, but you should consider the possibility of going to trial if you feel you could be awarded more compensation.  If you do decide to proceed with a court case then you will need to hire a lawyer to represent you as your final award will be decided by a judge and jury.  It should be noted that going is no guarantee that you will receive a larger award than what you have already been offered, so your lawyer will advise you whether it is worthwhile going to court or to settle with the insurance company.

The final decision on settling your claim will rest with you because although your Maryland personal injury lawyer can advise you on the best course of action they cannot always guarantee you will receive a higher offer either by going back to the insurance company or by going to court.  You will need to decide whether an award is sufficient to cover all your losses and how you want to settle your claim.

The advice of an experienced lawyer should always be sought before proceeding with a personal injury claim.  They will be able to advise you on whether or not your claim is worth proceeding with and the level of compensation you can expect to receive, this may not be enough to cover all your losses to date in which case it would not seem worthwhile proceeding.  A lawyer will be able to handle all aspects of your claim for you including negotiating settlements and finalizing payment of your compensation once you decide to accept.
